

Uniqlo Co., Ltd. (hereinafter referred to as “Uniqlo”) solely determines and sets out the following the terms and conditions which customers shall follow to use its services, including photo posting and My Page profile development and publication, by using the UT Web site operated by Uniqlo (hereinafter referred to as the “Terms and Conditions”). (Such services shall be hereinafter referred to as the “Services” and such customers shall be hereinafter referred to as “Users”.)
Article 1: Use of the Services
- 1-1. Users of the Services shall comply with the Terms and Conditions and any other terms and conditions for using any other services as separately stipulated by Uniqlo.
- 1-2. Uniqlo may change the contents of the Services without giving prior notice.
Article 2: User Registrations (UT Account Registrations)
- 2-1. When a user accesses the Services for the first time, he/she shall be required to apply to make his/her UT Account registration. Such a User shall make his/her UT Account registration by following the steps provided on the UT Account Registration page of the website.
- 2-2. To respond to such an application as described in Paragraph 2-1 above, Uniqlo shall accept and approve said application by sending e-mail to said User to acknowledge the receipt of his/her registration.
- 2-3. Uniqlo reserves the sole right to disapprove a User’s application for registration if said User’s application for registration has been disapproved on a prior occasion due to violation of the Terms and Conditions or for any other reason, or if said User’s application proves to contain a false claim(s) or statement(s), or if Uniqlo deems that said User’s registration is otherwise inappropriate.
Article 3: Notification for Changes in Registered UT Account Information
In the event that there are any changes in a User’s e-mail address, homepage URL or any other items already registered as part of his/her UT Account information, said User shall notify such changes to Uniqlo by following the procedures stipulated in Paragraph 4 of Article 7 hereunder.
Article 4: Suspension of the Provision of the Services
In the event that any of the following events is applicable to the case of a User, Uniqlo may suspend the provision of the Services for said User or delete his/her UT Account registration without giving any prior notice to said User:
- 1. A User’s registration is found to have been deleted in the past for breaching any of the Terms and Conditions or for any otherreason;
- 2. A User commits any of the Prohibited Acts stipulated in Article 6 hereunder; or
- 3. A User otherwise breaches any of the Terms and Conditions hereunder.
Article 5: Password Management
- 5-1. A User shall be responsible for maintaining his/her password that he/she has determined to access the Services on his/her own.
- 5-2. A User may not assign, lease or disclose his/her password to any third party.
- 5-3. A User shall be solely responsible for any losses inflicted upon him/her attributable to a failure to appropriately manage or use his/her password, or any use by a third party or any other causes.
- 5-4. Uniqlo shall not be liable to a User for any eventuality after changing his/her password or any other information, as long as Uniqlo confirms his/her identification by following the process designated by Uniqlo.
- 5-5. In the event that a User finds any fraudulent use of his/her password by a third party, said User shall immediately notify Uniqlo of this fact.
Article 6: Prohibited Acts
- 6-1. Users shall be prohibited from any of the following:
- 1. Making a false claim(s) or statement(s) in the application for UT Account registration.
- 2. Any acts that actually or are believed to hinder the appropriate operation or that may prevent Uniqlo from providing the Services.
- 3. Any acts that infringe upon or may infringe upon trademarks, copyrights, privacy or any other rights held by any other Users, any other third parties or Uniqlo.
- 4. Any acts that actually or are believed to inconvenience, disadvantage or damage any other users, any other third parties or Uniqlo.
- 5. Any acts that actually or are believed to run counter to public order and morals or to breach any other laws or regulations.
- 6. Any acts of providing any information described in Paragraph 1 of Article 8 hereunder
- 7. Any other acts that Uniqlo deems as inappropriate.
- 6-2. If any dispute arises out of breaching the provision of Paragraph 1 above between a User and any right holder or a third party, said User shall resolve such a dispute under his/her own responsibility and at his/her own expense and shall indemnify and hold Uniqlo harmless from any and all liability or damages.
Article 7: User Information (Personal Information)
- 7-1. Uniqlo shall treat any personal information about Users obtained in the process of their using the Services (hereinafter referred to as “Personal Information”) in compliance with the “Personal Information Protection Law” and related laws and regulations in Japan in the following manner:
- 7-2 Personal Information that Uniqlo asks Users to provide in using the Services shall consist of:
- 1) E-mail address,
- 2) Gender,
- 3) Date of birth, and
- 4) Homepage URL
- 7-3. Uniqlo shall use Users’ Personal Information for the following purposes:
- 1) To provide the Services,
- 2) To provide information about Uniqlo (by sending its e-mail magazine, catalogs, direct mail and the like), and
- 3) To execute questionnaire surveys for the purposes of improving Uniqlo’s product development and services.
- 7-4. Users may update their Personal Information or discontinue the use of the Services by taking the procedures described below:
- 1) Contact the Uniqlo Online Store Support Center by phone to update Personal Information or discontinue the use of the Services:

- 2) Upon receipt of a request from a User for updating his/her Personal Information or discontinuing the use of the Services by calling the Uniqlo Online Store Support Center, Uniqlo shall confirm their identification before correcting or updating their Personal Information or discontinuing the provision of the Services for said User.*
- 3) Access the website to update Personal Information or discontinue the use of the Service:

Note: * Comments and photographic data already provided by Users before taking the procedures to discontinue the use of the Services shall not be deleted even after his/her discontinuing the use of the Services.
- 7-5. Personal Information shall not be disclosed to any third parties, in principle. Uniqlo may, however, provide Personal Information for the following third parties:
- 1) When Uniqlo assigns a third-party service to manage Personal Information.
- 2) If Uniqlo is asked by a government organization to disclose Personal Information for a reasonable reason.
In doing so, however, Uniqlo shall limit the extent of Personal Information it discloses in either one of the cases above to a necessary minimum. Uniqlo shall also strive to prevent Personal Information from becoming leaked, lost or altered by such means as entering into a “Personal Information protection agreement” with each of such third parties to which Uniqlo shall disclose such information.
- 7-6. Users shall fully acknowledge the following disclaimer clauses before using the Services:
- 1) Any comments posted by a User on his/her own shall be deemed as published information, regardless of contents contained in such comments. In the event of any problems arising out of such published information, Uniqlo shall not be responsible for such problems,
- 2) When Uniqlo executes joint promotion and other marketing programs with other websites, such programs may include links to the websites of promotion partners and promotion planning companies. In such cases, Users shall use their own discretions to disclose their personal information for registration under the rules and regulations stipulated on such linked websites. Uniqlo shall not be responsible for any problems arising out of or in relation to any of such personal information registered on such linked websites.
Article 8: Users’ Information Management
- 8-1. Uniqlo may delete all or part of photos, My Page information or any other information provided by Users, at its own discretion and without giving prior notice to such Users if such information is applicable to any of the following cases:
- 1) Contains an expression(s) that apparently slanders other Users, any third parties or Uniqlo, or that can be considered to constitute obscenity or malicious intent.
- 2) Contains any Personal Information such as a person’s name, address, phone number and e-mail address, regardless of to whom such information belongs.
- 3) Constitutes actual or potential infringement upon someone else’s intellectual property and other rights.
- 4) Intended primarily for commercial or solicitation purposes.
- 5) Has or is suspected to contain or have been created with any such potentially harmful computer program as one containing a computer virus or any other illegal or harmful elements.
- 6) Irrelevant to the Services.
- 7) In violation of any laws and regulations of Japan or those of any other country applicable.
- 8) When legally ordered by a government organization(s) to do so.
- 9) Any other cases that Uniqlo deems inappropriate for operating the Services.
- 8-2. Users acknowledge in advance that Uniqlo shall examine all information provided by Users to check if such information may be applicable to any of the cases described in Paragraph 1 of this article above before publishing it on the website, which shall require a certain period of time between when Users provide information and when it is published on the Web.
Article 9: Suspension of the Services
- If any of the following cases occurs, Uniqlo may suspend all or part of the Services without giving prior notice to Users for the purpose of maintaining the good operational condition of the Services:
- 1) Regularly scheduled or emergency system maintenance.
- 2) System breakdown or difficulties due to fire, power outage, sabotage by a third party or any other events, or
- 3) Any other conditions under which Uniqlo deems system suspension as necessary.
Article 10: Disclaimers
- 10-1. Uniqlo shall not be held liable for any of the following cases:
- 1) A User suffers damage or disadvantages in connection with UT photo posting or My Page profile development,
- 2) A User has damaged or disadvantaged the interests of another User or any third party in the process of using the Services (including any detriment arising out of said User’s photos, My Page or any information thereon being unpublished or deleted, or anything else that may happen to such information),
- 3) A User has been unable to use any Services for any reason.
- 10-2. Users shall pay any expenses incurred in connection with the installment of the computer and communications hardware and software necessary for using the Services, and telephone, LAN or any other communications equipment use and subscription application and service charges necessary for using the Services.
- 10-3. Users are recommended to use one of the following browsers to use the Services:

- 1) For Windows: Internet Explorer version 6.0 or higher or Firefox version 1.5 or higher.
- 2) For Macintosh: Safari version 2.0 or higher.
Article 11: Other
- 11-1. The Terms and Conditions may be subject to change without giving prior notice.
- 11-2. Should any conflict occur between Uniqlo and a User with regard to the use of the Services and cannot be resolved hereunder, the parties hereto shall act in good faith to reach a settlement.
- 11-3. Should it be found necessary to bring such conflict arising out of or in relation to the use of Services to court, the parties hereto shall submit to the exclusive jurisdiction of the Tokyo District Court for the first trial.
